Terms & Conditions

Last updated: 12 October 2026

1. About these terms

These Terms & Conditions apply to the LoKo app, website, business portal and related services (“Platform”), operated by LOKOAPP PTY LTD (“LoKo”, “we”, “us” or “our”). They cover visitors, account holders, business owners, advertisers and event organisers. A person acting for a business must have authority to bind it.

Please read these terms before creating an account, submitting a listing or making a purchase. We ask you to accept the applicable terms during registration or checkout. Specific package and promotional conditions disclosed before purchase form part of the agreement. Mandatory legal rights prevail over inconsistent terms.

Our Privacy Policy explains personal information handling. Our Data Deletion & Account Closure page explains closure and deletion. Neither document removes your statutory rights.

2. What LoKo does

LoKo helps people discover local places, businesses, events and experiences, save ideas to their LoKo List and find information or external directions and booking links. LoKo provides discovery and advertising services. Listing an activity does not make LoKo its organiser, operator, ticket seller, safety assessor or insurer.

Unless expressly stated otherwise for a particular service, bookings, purchases and attendance arrangements are between you and the relevant provider. Its prices, entry conditions, cancellation rules and terms apply to that transaction. LoKo remains responsible for the services we ourselves supply and cannot exclude responsibilities that the law imposes on us.

LoKo does not offer public star ratings or public review/comment feeds as part of its current discovery service. Engagement figures, recommendations and paid placements are not independent reviews or endorsements.

3. Eligibility and account security

You must be at least 13 to create an account. If you are 13–17, you must have permission from a parent or legal guardian and use age-appropriate features. You must be at least 18 to buy a membership or paid listing or enter a paid advertiser agreement.

Provide accurate information, use an account you are authorised to operate and keep verification and login credentials secure. Tell us promptly about suspected unauthorised access. You are responsible for activity you authorise and reasonable account security; these terms do not make you automatically liable for misuse caused by our failure to provide reasonable security.

4. Responsible use

You must not use the Platform to commit fraud, impersonate others, harass people, publish unlawful or discriminatory material, infringe intellectual property or privacy rights, spread malware, interfere with security, access another person’s account without authority or manipulate engagement figures. You must not use automated tools to extract personal information or bypass reasonable technical restrictions.

Reasonable personal sharing through the Platform’s available functions is permitted. Other commercial reuse, bulk extraction or exploitation of Platform content requires permission or another lawful basis. These restrictions do not remove rights or exceptions that applicable law gives you.

5. Listing eligibility and approval

LoKo focuses on places, events and experiences relevant to local discovery. Applications and submissions are subject to review for relevance, accuracy, safety concerns and compliance with these terms. Creating an account does not guarantee approval or publication.

Advertisers must have authority to represent the business or event and provide accurate names, locations, dates, categories, contact details and descriptions. We may request reasonable supporting information. We do not promise to independently verify every listing, permission, licence or insurance policy.

If a submission is declined, we will normally explain why and allow correction where practical. If we collect a listing payment and then refuse publication without providing the purchased service, we will refund that payment, subject to any separately agreed service actually provided and your statutory rights.

6. Organiser responsibilities, licences and insurance

Advertisers and organisers are responsible for the activities they promote, including lawful operation, necessary permissions and licences, venue access, safety arrangements, accessibility information, supervision, age restrictions, participant communications and obligations to customers.

Businesses and organisers advertising through LoKo must maintain public liability insurance appropriate to their promoted activities and comply with any other insurance requirements imposed by law or their venue. We may request evidence. A listing or approval does not mean that LoKo has verified insurance or that the activity is covered by LoKo’s insurance.

You must promptly update cancellations, changed dates, closures and material changes. Do not advertise activities or claims that are unlawful, misleading, outside your authority or inconsistent with the purchased listing.

7. Visiting places and attending events

Check details with the provider before travelling, booking or attending, including opening hours, availability, prices, access, weather, suitability, age limits and cancellations. A “free” listing describes the stated activity or access; optional purchases, parking or other costs may still apply.

Exercise reasonable care, respect private property and follow lawful directions, local rules and conditions. Outdoor locations can involve weather, water, terrain and other risks. LoKo content is not an assurance that every location is safe, accessible or suitable for every person. Nothing here excuses an organiser or LoKo from a duty that cannot lawfully be excluded.

8. Standard packages and prices

Exploring the consumer app and saving discoveries is free. Paid advertising packages are:

  • Business Membership: $39 per quarter, billed every three months, equivalent to $13 per month. It includes an approved business profile, listing management, available engagement insights and three included event listings per calendar month.
  • Standard Event: $15 per event, a one-off payment for a listing lasting up to 30 days.
  • Featured Event: $30 per event, a one-off payment for a listing with the Featured placement described at checkout, lasting up to 30 days.
  • Quick Event: $5 per event, a one-off payment for a listing lasting up to 14 days.

Prices are in Australian dollars. The total payable, including any applicable taxes and mandatory charges, will be shown before you agree to pay. A per-event purchase is not a recurring subscription. If a separately displayed promotion applies, its confirmed price and inclusions take precedence for that purchase.

Event durations are maximum publication periods, not a promise to keep an ended or cancelled event in the discovery feed. The start, expiry and placement conditions must be disclosed before purchase. Unused monthly included listings do not roll over, have no cash value and do not include paid Featured upgrades unless expressly stated. An upgrade fee must be disclosed and accepted before charging.

9. Approval, payments and renewal

Business registration is an application. Paid membership activation follows approval and confirmation of the applicable payment or promotion. Listing publication may require approval and an active membership, event purchase or approved promotional entitlement.

Payments are processed through Stripe or the payment method identified at checkout. By expressly agreeing to a recurring membership, you authorise the disclosed quarterly charge until cancelled. Renewal dates and charges must be clearly shown when you subscribe. We will not treat a one-off event purchase as agreement to quarterly renewal.

If a payment fails, we may notify you and ask you to update payment details. We may pause paid benefits while payment remains outstanding, with a reasonable opportunity to resolve the issue. We will not impose an undisclosed penalty or take a duplicate payment for the same charge.

10. Launch offer: first 100 approved businesses

The launch offer provides 12 months of free Business Membership and four included event listings per calendar month to the first 100 eligible businesses approved and allocated an offer place by LoKo. Submitting an application does not reserve a place. We confirm eligibility, allocation and activation in writing.

The 12-month period begins on the membership activation date confirmed by LoKo. The offer is limited to one allocation per approved business, is not transferable or redeemable for cash and cannot be used to create duplicate memberships. Unused monthly listings do not roll over. Paid Featured upgrades and other separately purchased services are excluded unless expressly included in the offer confirmation.

At the end of the offer, continued paid membership requires a clear choice and express agreement to the then-current price and renewal terms. We will not automatically start charging merely because you accepted free launch membership. Without a paid agreement, paid membership benefits may end at expiry.

We may close the offer to new applicants once all places are allocated. Confirmed benefits will not be withdrawn or reduced without an appropriate reason, such as fraud or a material breach, and the fair suspension process below. Any separately agreed written offer terms prevail only for that offer and only to the extent lawful.

11. Cancellation and account closure

You may cancel future membership renewal using the cancellation controls provided or by emailing loko@lokoapp.com.au from your registered email address. A clear request received before the renewal charge is processed stops that renewal; there is no arbitrary extra notice period. We will confirm the cancellation. If we charge after receiving a timely cancellation, we will correct and refund that charge.

Cancelling renewal ordinarily leaves membership available until the end of the paid period. Deleting your account closes access and cancels future membership renewals. Uninstalling the app, logging out or removing a saved listing does not cancel a subscription.

Fees already paid are not ordinarily refunded solely because you change your mind, use fewer benefits or voluntarily delete your account before the paid period ends. This does not limit a refund or other remedy available under law or another promise in these terms. Save any invoices and other records you need before closure.

12. Event changes, cancellations and refunds

Contact us as soon as an event changes or is cancelled. Organisers remain responsible for notifying participants and handling ticket or attendee refunds under their own agreements and applicable law. A LoKo advertising fee is separate from an event ticket.

After an approved listing is published, its advertising fee is ordinarily not refundable solely because the organiser changes plans, the event is cancelled or engagement is lower than hoped. If LoKo fails to provide the purchased advertising service, a submission is not published after payment, or another legal entitlement applies, we will provide the required refund or other remedy.

If a material outage prevents delivery of a paid placement, we will assess an appropriate remedy, such as restoring or extending the service or refunding the undelivered portion. You do not have to accept a credit instead of a refund where the law gives you a refund right. Contact us with your transaction details; statutory rights are not subject to an artificial reporting deadline.

13. Visibility, recommendations and Featured placement

Feed position and visibility can depend on location, interests, engagement, timing, available content and purchased placement. Featured or sponsored listings must be identifiable as paid promotion where required. We do not guarantee a particular number of views, saves, enquiries, bookings, sales or attendees.

Featured placement means the benefit described for the purchased package; it does not automatically promise exclusive placement or the first position in every user’s feed. Engagement figures are indicative and may be adjusted to remove suspected automated or invalid activity.

14. Your content and permissions

You retain ownership of material you submit. You grant LoKo a non-exclusive licence to host, reproduce, display, distribute and make technical or formatting changes to that material as reasonably necessary to operate the Platform and promote the submitted business or event through LoKo’s channels. The licence is royalty-free and operates wherever those channels are available. Service providers may use the material only as needed to perform those functions for us.

The licence does not authorise unrelated sale of your content, misleading endorsements or use beyond those purposes. You must own the material or have the permissions needed for the intended use, including copyright, trade mark and any required consent from identifiable people. Do not upload another organisation’s photography merely because it is online, tagged or available in a content hub.

On removal or account deletion, we stop new uses and remove content from channels we control within a reasonable time, subject to lawful records and backup handling. Previously distributed printed material and third-party copies may not be retrievable. Promotional reuse must be consistent with your instructions and applicable privacy rights. Contact us to raise a permissions issue.

15. LoKo intellectual property and external services

LoKo branding, software and original Platform content belong to LoKo or its licensors. You may use the Platform and available sharing functions for their intended purposes. You may not commercially reproduce our branding or protected content without permission or another lawful entitlement.

Maps, payment services, app stores and external booking sites may have their own terms. A link does not imply a partnership or endorsement. We do not control external services, but remain responsible for our own selection and delivery obligations to the extent required by law. We are not affiliated with Experience Gold Coast, councils or a listed provider unless that relationship is expressly and accurately stated.

16. Moderation, suspension and complaints about content

We may reasonably reject, correct, restrict or remove material that is unlawful, misleading, outside LoKo’s discovery scope, infringes rights or breaches these terms. We may suspend an account for serious or repeated breaches, fraud, security threats or unresolved payment issues.

Where practical, we give reasons and an opportunity to correct the problem before suspension. Immediate action may be necessary for safety, security or legal reasons. You may ask for a review by emailing us. We consider the circumstances and act proportionately. If we stop a paid service without your material breach or another lawful justification, we will provide a refund for its undelivered portion or another remedy you agree to.

Report inaccurate content, rights infringements or safety concerns with the listing link, the issue and supporting details. Reporting does not authorise use of another person’s private information beyond what is necessary to investigate.

17. Availability and changes

We take reasonable care in providing LoKo, but uninterrupted access and completely error-free third-party information cannot be guaranteed. Features may be temporarily unavailable for maintenance or events outside our reasonable control. We will take reasonable steps to reduce disruption and meet applicable service obligations.

We may improve features and change future prices or terms for legitimate operational or legal reasons. Material adverse changes affecting an ongoing paid membership will normally be notified at least 30 days before taking effect, or earlier if you agree. Where an urgent legal or security change needs to happen sooner, we will explain it as soon as reasonably practical.

If a material change substantially reduces an agreed paid benefit, you may cancel without a penalty and receive an appropriate refund for prepaid, undelivered services. Price changes apply to future purchases or renewals after disclosure, not retrospectively to a completed purchase. We will not rewrite a confirmed free offer without the protections described above.

18. Australian Consumer Law and liability

Australian Consumer Law and other applicable laws may give you guarantees and remedies that cannot be excluded, restricted or modified. Those rights are preserved. A statement that a service is free, that a payment is ordinarily non-refundable or that a third party supplies an activity does not remove any non-excludable obligation of LoKo.

Subject to those rights, LoKo is not responsible for the independent conduct of businesses, organisers or attendees merely because a listing appears on the Platform. We remain responsible to the extent a loss is caused by our own breach, negligence or other conduct for which we are legally liable.

To the extent lawful and reasonable, neither party is liable to the other for loss that was not reasonably foreseeable when the relevant agreement was made. Nothing in these terms excludes liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any liability that cannot lawfully be excluded.

19. Advertiser responsibility for third-party claims

A business or advertiser is responsible for reasonable, documented losses and third-party claims to the extent directly caused by its unlawful conduct, negligent act, material breach of these terms or use of content without required rights. This responsibility is reduced to the extent LoKo or another person caused or contributed to the loss.

LoKo must give prompt notice of a claim, take reasonable steps to reduce losses and give the advertiser a reasonable opportunity to participate in its response. We will not agree to a settlement requiring the advertiser to pay without its consent, which must not be unreasonably withheld. This clause does not impose a general indemnity on ordinary consumer users.

20. Complaints, disputes and general terms

Contact us first where practical so we can try to resolve a problem. We aim to provide a substantive complaint response within 30 days, or explain any delay. This process does not prevent you from contacting a regulator, seeking urgent relief or exercising legal rights. Mediation may be used if both parties agree; it is not a compulsory barrier to bringing a claim.

These terms are governed by Queensland law, subject to mandatory laws that apply to you. Queensland courts have non-exclusive jurisdiction; this does not remove access to another court or tribunal with lawful jurisdiction.

If a provision is invalid, the remaining terms continue to the extent they can reasonably operate. Failure to enforce a right once does not waive it permanently. A transfer of our business must not reduce your existing contractual or privacy protections.
